These Terms & Conditions (“Terms”) govern your access to and use of the website located at www.a1rwater.com (the “Site”) and any related services, content, features, products, and purchases offered by A1R water (together, the “Services”). The Site and Services are operated by Air Water Ventures Holdings Ltd. (“A1R water,” “we,” “us,” or “our”).

By accessing the Site, creating an account, placing an order, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy (a1rwater.com/privacy-policy). If you do not agree, do not use the Services.

Important: These Terms contain limitations of liability and other provisions that affect your legal rights. Please read carefully.

1) Eligibility / Age

You represent that you are at least the age of majority in your province/state of residence and that you have the legal capacity to enter into these Terms. The Services are not intended for children.

2) Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date reflects the latest version. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

3) Privacy

4) Accounts

You may need an account to access certain features. You agree to:

  • Provide accurate, current information
  • Maintain the confidentiality of your login credentials
  • Promptly update account information
  • Accept responsibility for all activity under your account
  • We may suspend or terminate accounts that we believe violate these Terms or create risk for the Services, other users, or A1R water.

5) License to Use the Site

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes, subject to these Terms.

6) Prohibited Uses

You agree not to:

  • Interfere with Site operation or security (e.g., hacking, introducing malware)
  • Scrape, crawl, or harvest data without our written permission

  • Misrepresent affiliation with A1R water or use the brand in a misleading manner

  • We may suspend or terminate access for violations.

7) Intellectual Property

All content on the Site—text, graphics, logos, product names, designs, images, videos, and the overall “look and feel” (the “Content”)—is owned by A1R water or its licensors and is protected by intellectual property laws.
You may not use our trademarks, logos, or brand elements without our prior written consent.

8) User Content (Reviews, Comments, Submissions)

If you submit or post content (e.g., reviews, testimonials, photos, videos, comments) (“User Content”), you represent that:

  • You own or have the rights to submit the User Content
  • Your User Content does not violate law or infringe third-party rights
  • Your User Content is not defamatory, harassing, obscene, or harmful

License

By submitting User Content, you grant ‘A1R water’ a worldwide, perpetual, irrevocable, royalty-free, sublicensable, transferable license to use, reproduce, modify, publish, translate, distribute, display, and create derivative works of your User Content for business purposes (including marketing, advertising, and product pages), in any media now known or later developed, without compensation to you, except where prohibited by law.
We may remove User Content at any time for any reason.

9) Third-Party Links and Tools

The Services may contain links to third-party websites or tools (including social platforms). We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

10) Disclaimers

THE SERVICES AND ALL CONTENT, PRODUCTS, AND MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We do not warrant that the Services will be uninterrupted, secure, or error-free, or that defects will be corrected.

No health claims. Any information on the Site is for general informational purposes and is not medical advice. Always seek guidance from a qualified professional for health concerns.

11) Limitation of Liability

To the maximum extent permitted by law, A1R water and its affiliates, officers, directors, employees, agents, suppliers, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the services or products, even if advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the services or products shall not exceed the amount you paid to us for the product(s) or service(s) giving rise to the claim in the 3 months preceding the event or $100.00, whichever is greater), unless required otherwise by law.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12) Indemnification

You agree to indemnify, defend, and hold harmless A1R water and its affiliates, officers, directors, employees, agents, and service providers from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising from or related to:
Your use of the Services

  • Your violation of these Terms
  • Your User Content
  • Your infringement of any rights of a third party

13) Dispute Resolution (Optional – Legal to Confirm)

Any dispute arising out of or relating to these Terms or the Services will be brought in the courts located in The State of Florida, and you consent to jurisdiction and venue there, subject to mandatory consumer protection laws.14) DMCA / Copyright Complaints (Optional)

If you believe content on the Site infringes your copyright, please send a notice to: info@a1rwater.com

Your notice should include: identification of the work, identification of the allegedly infringing material, your contact info, a good-faith statement, and a statement under penalty of perjury that the notice is accurate and you are authorized to act.

15) Termination

We may suspend or terminate your access to the Services at any time if we believe you violated these Terms or if required to protect the Services, our customers, or our rights.
Sections that by their nature should survive termination will survive (including intellectual property, disclaimers, limitation of liability, indemnity, dispute provisions).

16) Severability

If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.

17) Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets.

18) Entire Agreement

These Terms, along with the Privacy Policy and any additional policies referenced (including the Refund Policy), constitute the entire agreement between you and A1R Water regarding the Services and supersede any prior agreements or understandings.

19) Governing Law

These Terms are governed by the laws of The State of Florida, USA, without regard to conflict of laws principles, subject to mandatory consumer protection laws.
